1. Scope
These terms apply to the app “Moomli’s Kitchen” (iPhone, iPad, Android and web app) and the website playmoomli.com. The provider is Smart Marketing Commerce LLC, 16192 Coastal Highway, Lewes, Delaware 19958, USA.
2. What the app offers
Moomli’s Kitchen is a cooking game for children. Three recipes are free to play. You unlock all other recipes, including those added later, with a subscription (monthly or yearly) or a one-time purchase.
3. Purchases and subscriptions
- Purchases are made through Apple’s App Store or Google Play, whose terms also apply. Payment is charged to your account there when you confirm the purchase.
- Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- You can cancel at any time in the subscription settings of your App Store or Google Play account. Cancellation takes effect at the end of the paid period.
- The one-time purchase has no time limit for as long as the app is offered and technically supported.
- Refunds are handled by Apple or Google under their rules. Your statutory consumer rights remain unaffected.
- Use “Restore purchases” in the parents’ area to use your purchase on other devices with the same account.
4. Apps from the App Store
For apps downloaded from the App Store, Apple’s Standard License Agreement (EULA) also applies. We, not Apple, are responsible for maintenance and support of the app.
5. What you may do with the app
You receive a simple, non-transferable right to use the app privately. You may not copy, modify, reverse engineer, resell or publicly perform the app or its content.
6. For parents
The app is made for children; parents are responsible for its use and for screen time. Purchases and settings are meant for adults and are therefore protected.
7. Cooking in real life
The app is only a game. Its recipes are not cooking instructions. If you cook for real afterwards, please do so only with an adult and take care with the stove, knives and allergies.
8. Availability and updates
We keep developing the app and may change content as long as the core of what you bought remains. We cannot guarantee uninterrupted availability of the web app.
9. Liability
We are liable without limitation for intent, gross negligence and personal injury. Otherwise we are only liable for breaches of essential obligations, limited to the typically foreseeable damage. Mandatory consumer rights remain unaffected.
10. Changes to these terms
We may update these terms, for example if the app or the law changes. We will announce material changes in good time in the app or on this page.
11. Governing law
These terms are governed by the laws of the State of Delaware, USA. If you are a consumer living in the EU, the mandatory consumer protection rules of your country of residence also apply and you may also bring claims there.
